The Eviction Moratorium is Ending. What you can do now?

The eviction moratorium is set to expire on June 30, 2021, so you may find yourself wondering what you can do now to save your apartment.  Chapter 13 may be able to help you save your apartment but you must act quickly.  Chapter 13 is a great option to repay your rent over time.

In Charlotte, we can often file a Chapter 13 bankruptcy to repay the rental arrears over six (6) months but you must act quickly!  The Bankruptcy Code protects landlords who obtain an eviction judgment before a Chapter 13 bankruptcy is filed.  If an eviction judgment is obtained before a Chapter 13 bankruptcy then the Bankruptcy Code only allows up to 30 days to repay the past due rent.  What does this mean?  It means that if the Chapter 13 bankruptcy is not filed before the eviction hearing then you could miss out on a great way to repay the rent and save your apartment.
